Radzik and Deane-Hughes v Environmental Protection Agency

The legal claims: The two litigants claim that the EPA acted unlawfully when granting an environmental permit to Exxon.
The story of the case: The judge concluded that the EPA’s decision to grant the permit was unlawful but did not grant a remedy. We have appealed against that part of the decision.
The judge also stated that the applicants who were seeking to uphold the rule of law were to be regarded as public benefactors, not meddlesome busybodies who were obstructionist. This was a direct rebuttal of public statements by the Attorney-General calling public interest litigants ‘obstructionist.’
