The Legal Claims:

1) The Environmental Protection Agency (EPA) has failed to comply with the ruling of Justice Ramlall, which requires that any Environmental Impact Assessment (EIA) must include Scope 3 emissions (emissions from the use of extracted fossil fuels).

The Story of the Case:
Morris and Marcus filed their application on 29th July 2025, arguing that the EPA unlawfully approved Exxon’s 7th oil project without requiring the Environmental Resources Management (ERM)–prepared EIA to include Scope 3 emissions, despite Justice Ramlall’s earlier binding decision.

They contend that the EPA and ERM have acted in violation of national law and in breach of a standing court order. The claimants argue that Scope 3 emissions represent the largest share of greenhouse gas emissions linked to oil production, and excluding them undermines the integrity of the EIA process and Guyana’s environmental protections.

The matter has been filed, and a hearing date is awaited.
